We take your privacy very seriously and are committed to protecting the privacy of all visitors and subscribers to our website or any application we make available (the “Platform”), and the corresponding services available through the Platform (the “Services”).

Below we set out our privacy policy, which will govern the way in which we process any personal information that you provide to us. We will notify you if the way in which we process your information is to change at any time.

Please read this privacy policy carefully as it contains important information on who we are and how we collect, store, use and share your information. By accessing the Platform or using our Services or otherwise indicating your consent, you agree to, and where required, consent to the collection, use and transfer of your information as set out in this policy. If you do not accept the terms of this policy, you must not use the Platform and/or the Services. This privacy policy supplements other notices and privacy policies and is not intended to override them.

This privacy policy:

  1. applies only to the Platform and not to website or applications of any other companies or organisations; and
  2. specifically addresses our obligations pursuant to local law.

Who are we?

Abu Dhabi Arts Society, ADAS is the data controller of your Personal Data processed in connection with its operations.

The data we collect about you

When you visit our Platform, or create a login in and password to access the Services, you may be asked to provide information about yourself. This may include:

  1. your name and contact details, including email address and telephone number;
  2. information to enable us to check and verify your identity;
  3. location data;
  4. our billing information, transaction and payment information and history; and
  5. such other information as we may from time to time require to provide the Services and comply with applicable law.

You agree and, where required. consent to, the collection of information about your usage of the Platform and the Services and information from messages and communications you send to us. This information is required to provide the Services to you. If you do not provide such information, it may delay or prevent us from providing the Services.

This privacy policy will also apply when accessing the Platform and/or the Services from mobile technology (such as mobile phones, tablets or other device). Unless you have chosen to remain anonymous through your device and/or platform settings, this information may be collected and used by us automatically if you use the Services and access the Platform from mobile technology.

Calls between you and us, or between you and third parties made through us (such as members you contact about a good through a form or link on our website, or using contact information found on our website), may be recorded or monitored for quality assurance and customer service purposes. As part of this process, we and our service providers will receive in real time and store data about your call or text message, including the date and time of the call or text message, your phone number, and the content of the text message.

We may collect Personal Data directly from you (by email, telephone, face to face, in paper form and via our website and digital applications), including when you:

  • express an interest in our Services or interact with us as a client or prospective client;
  • subscribe to our newsletters, digital applications and catalogues;
  • create a ADAS or HART account on our websites, inform us of your collecting interests and/or download and use HARTS‘ digital applications;
  • instruct us to provide Services to you and sign contractual documentation;
  • attend viewings, auctions, events and exhibitions.

Collection from other sources

We may collect Personal Data about you and the property you own or wish to collect from sources outside, including when:

  • we carry out required due diligence checks on you and your property
  • we carry out required credit reference checks
  • someone introduces you to us;
  • you access our Services through third party social media networks or services.
  • we use the services of unaffiliated third-party advertising networks, media monitoring companies and publicly available sources.

Automated data collection

When you visit our website or download one of our digital applications or interact with third-party websites, we collect data to facilitate and personalise your experience, for security and analytical purposes (including trend analysis) and system administration.

Data we collect automatically may include:

  • data about you, your computer and other devices you use to access our website and digital applications (including your IP address, browser information, device information, and operating system information);
  • search terms and URL’s used to reach our website and digital applications;
  • data regarding the emails we send you, such as opens, clicks, and unsubscribes;
  • your interaction with our websites and digital applications (such as the date, time, length of stay, and pages accessed during your visits);
  • usage data for our websites and digital applications (such as the number and frequency of visitors).

We may associate this data with the following:

  • your HART or ADAS account (if you have one),
  • the device(s) you use to connect to our Services; and/or
  • email or social media accounts that you use to engage with HART or ADAS.

When you visit our premises and sale and exhibition venues, we may record your image through our CCTV operations for security, client service and bid-monitoring purposes. Our auctions are also filmed for simultaneous live broadcast on our and third party websites and applications.

Your communications with our team, including by telephone and online (e.g. telephone and on-line bidding) may also be recorded for security, client service and bid monitoring purposes. Where we record such information we will process it for the purposes set out below.

Third-party social media services

When you access our Services through a social network (such as Facebook, Instagram and Twitter) we collect information about you from the social network in accordance with your settings on the social network. If you interact with us on social media, we will collect information about those interactions. The information we may collect includes your name and email address.

Who we share your personal information with

Your personal information (which includes your name, address and any other details you provide to us which concern you as an individual) may be processed both by us and by other companies within our group. Each of the companies in our group authorised to process your information will do so in accordance with this privacy policy.

We may also share your information with:

  1. third parties we use to help deliver our products and services to you (for example, payment service providers);
  2. other third parties we use to help us run our business (for example, marketing agencies or website hosts); and
  3. third parties approved by you (for example, social media sites you choose to link your account to or third party payment providers).

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

We may use or share the information you provide to us if we are under a duty to disclose or share your information in order to comply with any legal or regulatory obligation or in order to enforce any obligation against you or to protect the rights of us and our affiliates. This may include the exchange of information with other companies and organisations for the purposes of fraud protection and prevention.

We may also need to share some personal information with our affiliates, subsidiaries and third parties or during a re-structuring of our business. Usually, personal information will be anonymised but this may not always be possible.

Purpose of processing

Your information will allow us to provide you with access to the particular parts of the Platform relevant to you and allow us to supply the Services you require.

We will use your information for the purpose of fulfilling service orders placed by you, processing any other transactions authorised or made by you with us, informing you of special offers and providing other marketing information to you which we think you may find of interest, undertaking services or customer research/development.

Your information may be used by us to contact you for your opinions on the Platform, the Services and our business, and to notify you of changes or developments to the Platform, the Services and our business.

Cookies

We may send a small file to your computer or device when you visit our website (a “cookie”). This will enable us to identify your computer, track your behaviour on our website and to identify your particular areas of interest so as to personalise and enhance your experience on this website. We may use cookies to collect and store personal data and we link information stored by cookies with personal data you supply to us. You can set your browser to reject cookies but this may preclude your use of certain parts of the Platform.

If you participate in or inquire about any lead, referral or similar service we may offer, we may use the information you submit, as well as other data we might have or obtain ourselves or from other sources, to determine which of our participating Professional(s) may be willing, able and/or compatible to serve your needs or possible interests and to assist them or others in doing so. We may forward or share information relating to you, which may include such information as well as personal information obtained through our sign-up form or otherwise, to certain Professional(s). Those Professionals or their affiliates, traders, owners, agents or other designees may use such information and contact you regarding your needs or possible interests, as may we ourselves. “Professional(s)” means individuals, companies and other organisations or persons acting as real estate professionals or otherwise engaged in a business relevant to the Platform.

Security measures

We have implemented security policies, rules and technical measures to protect the personal data that we have under our control from unauthorised access, improper use and disclosure, unauthorised destruction or accidental loss.

We also have procedures in place to deal with any suspected data breach. We will notify you and any applicable regulator or authority of a suspected data security breach where we are legally required to do so.

You are solely responsible for keeping your password and other account details confidential. If you have concerns about your password, account details, or are suspicious about any unauthorised use of your account, you should contact us immediately. We can deactivate or suspend your account at any time.

Access to information

You may ask us whether we are storing personal information about you by emailing us at contact@h-art.ae and, if you wish and upon payment of a fee of AED 500, we will provide you with a copy of the personal data we hold about you by email. We may ask for proof of your identity before providing any information and reserve the right to refuse to provide information requested if identity is not established.

Inquiries

If you have any enquiry or concern about our privacy policy or the way in which we are handling personal data please contact us at using the following email address emailing us at contact@h-art.ae. If at any time you wish us to cease processing your information please send a message to our admin department and insert “unsubscribe” as the subject heading.

SHARING YOUR PERSONAL DATA

We may share your Personal Data with other parties for the purposes referred to in this Privacy Policy and relying on the legal grounds for processing described above, including:

  • any member of the Group (including employees, staff and contractors) for purposes including notifying you of offers, events any other which may be of interest to you.
  • anyone who provides services to members of the the Group, their agents or affiliates for purposes including notifying you of of offers, events any other which may be of interest to you or anyone acting on your behalf.
  • financial institutions, credit reference agencies, fraud prevention agencies and internal and external auditors, professional advisors
  • law enforcement and judicial, administrative and regulatory bodies;
  • third parties:
  • in connection with subpoenas or other legal requests submitted to any Group member.
  • for marketing purposes where you have consented to marketing.

We are committed to ensuring that any Personal Data we hold about you is properly safeguarded. We seek to prevent unauthorised access or disclosure, we have put in place appropriate physical, electronic and managerial procedures to protect your Personal Data against unauthorised access or disclosure and any loss, destruction or damage.

We endeavour to take all reasonable steps to protect your Personal Data from external threats, however, please be aware that there are inherent security risks of sending information by public networks or on public computers and we cannot therefore guarantee the security of any data disclosed or transmitted over the internet.

Please note that our Bids, Client Accounting and Shipping Departments may seek your credit card details and/or bank account information by email in order to take payment for transactions or guarantee payments. Please note that the security, confidentiality and reliability of email cannot always be guaranteed.

Things you can do

Where you sign up to participate in auctions or receive other Services, you may be provided with log-in information and may have the ability to set passwords to allow you to access a personal account page. Where we do so, it is on the condition that you will be responsible for ensuring that such log-in information and any passwords are kept secure and confidential at all times. You will not share any log-in information or passwords, without our express authorisation. We cannot be responsible for any loss or damage caused by your negligence, misuse of log-in details or your decision to share account access with others.

“phishing”

Sometimes unauthorised individuals send e-mails to consumers, purporting to represent a legitimate company, requesting that the consumer provide personal, often sensitive information, using the information (such as the email and domain names of) a legitimate, trusted company. In reality, such information is sought for identity theft. This illegal activity has come to be known as "phishing."

If you receive an e-mail or other correspondence requesting that you provide any sensitive information via e-mail or to a website that seems suspicious to you, please do not provide such information, and report such requests to us.

HOW TO CONTACT US

Please email us if:

  • you have any questions relating to the processing of your Personal Data by the Group;
  • you have previously given your consent to our processing of your Personal Data for certain purposes and wish to withdraw it for some or all of those purposes.
  • you wish to bring to our attention any concerns or complaints with the way we are processing your Personal Data.

Please note that if you withdraw your consent to our processing of your Personal Data for certain purposes, we may not be able to provide you with all or some of the Services unless other legal grounds exist justifying our processing of your Personal Data for these purposes.

Payment Data

We may employ a third-party provider for processing credit card payments. They have access to personal information needed to perform their functions, but may not use it for other purposes. We do not have access to or retain any of your payment information.

Updates to policy

We reserve the right to vary this from time to time. Our updated policy will be displayed on our Platform(s), and by continuing to use and access the Platform, following such changes, you agree to be bound by any variation made by us. It is your responsibility to check this policy from time to time to verify such variations.
